We understand your position, and we want to respect your feelings on the matter. Our attorney feels that the response back from Rappaport with the lease contingencies requiring additional deposits should be enough to secure a release of the earnest money deposit. Obviously your attorney gave you different information.


Even though our attorney feels confident that we can win this thing hands down, the reality is that anytime you go into court there’s always a risk, and the only person that wins guaranteed is the attorneys. We both genuinely like you Cathy, we don’t want this to be contentious, we don’t want to drag this out in court. To that end, we are willing to concede a portion of our deposit to at least make this a bit of a win for you, it won’t make up for the loss of the business and is a small drop in the bucket of everything you’ve gone through, but we’re willing to concede $3,000 of our deposit to you. Whether you choose to share that with Anthony or not is up to you.

We hope that you feel the earnestness in our attempt to try to come up to an amicable agreement.
